The first weeks
File the will with your local probate court
Most states require the will to be filed with the probate court within 30 to 90 days of the death, even if you don't plan to open full probate. The court clerk can tell you where and how. There's usually a small filing fee.
What you'll need
- The original will
- A certified copy of the death certificate
Good to know
Many states set a deadline, often 30 to 90 days, and missing it can bring penalties.
