Petition to open probate
If probate is needed, the executor named in the will files a petition with the county probate court. The court reviews the will, appoints an executor or personal representative, and issues Letters Testamentary. This paperwork gives you legal authority to act on the estate's behalf.
What you'll need
- The original will
- A certified copy of the death certificate
- Names and addresses of heirs
- A rough estimate of the estate's value
